劳动者未提前30天书面通知用人单位如何处理?

  律师,您好!想向您咨询一下,我妹妹之前在一家民营医院做护士,因为私人原因辞职,但是医院以辞职辞职提前一个月申请为由,拒绝支付工资,她进医院的时候就办的入职没有合同,请问您她的工资还能要回来吗?能有哪些途径呢?谢谢!

解答:

   您好,根据《劳动合同法》的规定,劳动者提前30天书面通知用人单位,可以单方面解除劳动合同,您妹妹这种情况,辞职后的一个月应当以矿工计算,用人单位可以拒绝支付该月工资,但不能以此为由拒绝支付此前的劳动报酬。建议您妹妹向劳动监管部门申诉或者申请仲裁。
