房产销售伪造文件骗取银行贷款,房屋买卖合同是否有效?

  去年年初,我母亲在星沙某楼盘购买了一套房产,由于之前在老家已经有一套房在我母亲名下,因此这套房本应算是二套。但房产销售为了吸引我母亲购买,主动承诺可以按照首套来贷款,并伪造了相应证明。最近我才得知此事,请问,这种情况能否认为购买合同无效了?此房已经交房了。

解答:

  解答:根据《合同法》的有关规定,商品房买卖合同是有效的,但是由于采用欺诈手段骗取银行贷款,会导致贷款合同无效。
